Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the AiBabyMotion website at aibabymotion.com and our mobile application (together, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy.
Eligibility
You must be old enough under applicable law to enter a binding agreement and to use the Services. If you use the Services on behalf of someone else (for example, a child), you represent that you have the authority to do so.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.
Your content
You retain rights to content you submit, including photos or other media you upload. You grant us the rights reasonably necessary to operate the Services—including hosting, processing, displaying, and creating outputs you request (such as AI-generated videos). You represent that you have the rights needed to submit your content and that it does not violate law or third-party rights. You remain responsible for how you use, publish, or share both your original materials and any outputs; see also “AI outputs” below.
Acceptable use
- No unlawful, harmful, harassing, hateful, or exploitative use.
- No attempt to reverse engineer, overload, or break security of the Services.
- No use of the Services to generate or distribute content that violates law or platform rules.
AI outputs
Generated results may be imperfect or unexpected. Outputs are provided “as is” without guarantees of accuracy, safety, or fitness for a particular purpose. You are responsible for how you use and share outputs.
Subscriptions and in-app purchases
Some features require a paid subscription or one-time in-app purchase processed through the Apple App Store. When you subscribe, billing, auto-renewal, and cancellation are governed by Apple’s terms and your Apple ID settings. You must cancel through the App Store (or as Apple directs) before a renewal date if you do not want to be charged for the next period. Price changes may be communicated by Apple according to its policies. Refunds, when available, are handled under Apple’s rules—we do not guarantee refunds outside those processes. We may receive limited purchase or subscription status data from Apple as needed to unlock features.
Push notifications
Push notifications are optional and require your permission on the device. If you opt in, you may receive transactional or service-related messages (for example, about generation status), and we may occasionally send product or promotional updates where permitted. You can disable or limit notifications at any time through your device settings (for example, iOS Notifications). Disabling notifications may mean you miss time-sensitive information about the Services.
Third-party platforms
Your use of the mobile app is also subject to terms, policies, and requirements that apply between you and Apple (including the Apple Media Services Terms and applicable App Store rules) and, where relevant, other platforms. If there is a conflict between those terms and these Terms, mandatory consumer protection rules or the platform terms may prevail to the extent required by law.
Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS (US$100).
Indemnity
You agree to defend and indemnify us against claims arising from your content, your use of the Services, or your violation of these Terms, to the extent permitted by law.
Termination
We may suspend or terminate access to the Services if you violate these Terms or if we need to for legal, security, or operational reasons.
Governing law
These Terms are governed by the laws that apply to agreements of this kind in your country or region of residence, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction require otherwise. Changes
We may modify these Terms from time to time. We will post updates on this page and update the “Last updated” date. Continued use after changes constitutes acceptance where permitted by law.
